1. Complaint that Rights Commissioner’s Decision r-071266-mw-08/EOS has not been implemented.
BACKGROUND:
2. A Complaint was submitted to the Labour Court in accordance with Section 31(1) of the National Minimum Wage Act, 2000. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under the National Minimum Wage Act, 2000, by Peter Joseph Nolan, Seaspray, Redcastle, Co Donegal,that his former employer, Flanagans of Buncrana Limited, Ballymacarry, Buncrana, Co Donegal, failed to implement a Decision of a Rights Commissionerr-071266-mw-08/EOS.
And the said Decision not having been carried out by the employer, and no appeal having been brought against the said Decision within the time limit for such appeal, the Court hereby determines that the said employer pay to the said complainant €2,649 in settlement of his claim under the National Minimum Wage Act, 2000, in relation to the underpayment of wages.
