1. Appeal of a Rights Commissioner's Decision r-082314-wt-09/TB.
BACKGROUND:
2. The Worker appealed the Rights Commissioner's Decision to the Labour Court in accordance with Section 28(1) of the Organisation of Working Time Act, 1997 on 6th April, 2010. The Court heard the appeal on 27th September, 2010, the earliest date suitable to the parties. The following is the Determination of the Court:
DETERMINATION:
The Claimant appealed against the decision of the Rights Commissioner but sought to have the decision affirmed. The Respondent did not cross appeal. At the hearing the Respondent argued that the award of the Rights Commissioner was excessive and ought to be reduced.
Having considered the submissions of the parties the Court can see no reasonable basis to interfere with the decision of the Rights Commissioner. According the decision is affirmed and the appeal is disallowed.
