1. Appeal under Section 83 of The Employment Equality Acts, 1998 to 2007.
BACKGROUND:
2. This is an appeal by the Complainants before the Equality Tribunal against the dismissal of their claim under the Employment Equality Acts 1998-2008.
The Court was informed by the Solicitor on record for the Appellants that one of his clients is deceased since the appeal was initiated and that the surviving Appellant was informed by him of the time, date and place of the sitting of the Court at which the appeal would be heard and advised to be present for the hearing. The surviving Appellant failed to attend or to communicate with the Solicitor in relation to the matter. The Court was also informed that the Solicitor has no instructions from the Personal Representative of the deceased Appellant. In these circumstances the Solicitor was unable to open the appeal.
DETERMINATION:
It is the Determination of the Court that the within appeal be struck out for want of prosecution.
