1. Complaint that a Rights Commissioner's Decision has not been implemented No. R-098583-WT-10/JC.
BACKGROUND:
2. The Worker concerned referred a decision of a Rights Commissioner No. R-098583-WT-10/JC to the Labour Court for implementation on the 12th July 2011, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Determination of the Court:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Przemyslaw Brajer, 107 Amiens Street, Dublin 1, that his former employer The Patton Flyer Limited , 2 The Castleyard, 20/21 St Patrick's Road, Dalkey, Co. Dublin failed to implement a decision of a Rights Commissioner No. R-098583-10/JC
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €3,000 in accordance with the decision of the Rights Commissioner.
