1. Hearing arising from FTD072
BACKGROUND:
2. The Employer appealed the Rights Commissioner's Decision to the Labour Court on the 10th November, 2006. A Labour Court hearing took place on the 18th January, 2007.
The Labour Court issued its Determination No. FTD072 on the 5th February, 2007. The issue of compensation remained unresolved between the parties. A Labour Court hearing took place on 3rd August, 2011. The following is the Court's Determination:
DETERMINATION:
This matter came before the Court arising from Determination No: FTD072 in which the Court left over the question of compensation due to the claimant under s.14(2) of the Act. The court noted that in open correspondence the Respondent measured the maximum amount which the claimant can justifiably claim at € 56,969.75.
Having regard to all the circumstances of the case the Court is satisfied that this amount adequately meets the terms of the Court's Determination in the substantive claim brought by the Claimant in FTD072. Accordingly the Court makes an award to the claimant in that amount.
