1. Appeal of Rights Commissioner's Recommendation r-081388-ir-09/EOS.
BACKGROUND:
2. This dispute relates to a change in the Worker's base for travel purposes. The matter was referred to a Rights Commissioner for investigation and recommendation. On the 31st March, 2010 the Rights Commissioner issued the following Recommendation:-
- “I recommend in full and final settlement of this dispute that the Council pay the claimant €1,500 compensation in recognition of his grievance concerning the change of his base”.
- “I recommend in full and final settlement of this dispute that the Council pay the claimant €1,500 compensation in recognition of his grievance concerning the change of his base”.
3. 1.The Workerhad an agreement with the Council concerning his base for the purpose of calculating travel expenses.
2.TheCouncil decided unilaterally to change this agreement.
3.The Council's decision has caused the Worker considerable financial loss.
EMPLOYER'S ARGUMENTS:
4. 1. The current economic climate has forced the Council to find greater efficiencies and cost savings.
2. The Council has not breaced the Worker's terms and conditions of employment.
3. The Council has offered to provide transport to the Worker.
DECISION:
Having carefully considered the extensive oral and written submissions of both parties in this case the Court upholds the Rights Commissioner's Recommendation and rejects the appeal.
