1. Complaint that a Rights Commissioner's Decision has not been complied with by the Employer No. R-080966-MW-09/JOC.
BACKGROUND:
2. The Worker referred his case for implementation of a Rights Commissioner's decision to the Labour Court on the 9th May 2011, in accordance with Section 31(1) of the National Minimum Wage Act, 2000. The following is the Determination of the Labour Court:-
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum wage Act, 2000 (the Act) by Muhammad Azam, c/o MRCI, 55 Parnell Square West, Dublin 1 that his former employer Amjad Hussein trading as Poppadom, 46 Rochfort Park, Lucan Co. Dublin failed to implement a decision of a Rights Commissioner No. r-080966-MW-09 JOC
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee
€42,415.28 in accordance with the decision of the Rights Commissioner.
