1. Remuneration, Pension and Cost Agenda
BACKGROUND:
2. The case was referred to the Court under Section 20(2) of the Industrial Relations Act, 1969. A Labour Court hearing took place on 18th April, 2011. Both parties agreed to be bound by the Recommendation of the Court.
RECOMMENDATION:
It is noted that the matters in dispute were the subject of intensive negotiations conducted with the assistance of an agreed external Facilitator. Following on from this process the Facilitator produced a set of proposals incorporating the Company's final position. This document was subsequently rejected by the Union.
The Court has carefully reviewed the document drafted by the Facilitator. In the Court's view the proposals contained in the document remain the fairest and most equitable basis upon which the matters in dispute should be resolved.
Notwithstanding its earlier rejection by the Union, the Court cannot see any reasonable basis on which it could recommend any changes to the terms of that document. Accordingly the Court recommends that it be accepted in its totality.
With regard to the future funding of post retirement increases in pensions, the Court notes the Company's letters to the Union dated 1st March and 18th April 2011 in which the issue was addressed. The Court recommends that, having regard to the content of both letters, the position set out in the letter of 1st March 2011 be accepted as providing a sufficient assurance on this matter.
