BACKGROUND:
2. This case concerns a dispute between the worker and his employer in relation to his continued employment. The worker claims that he has grievances in relation to his terms and conditions of his employment and that these grievances have not been dealt with adequtely by management. Management contend that the worker has not outlined his grievances in line with the appropriate procedures and that if he were to do so, all matters would receive immediate attention.
The worker referred the dispute to the Labour Court on 7th July, 2011 in accordance with Section 20(1) of the Industrial Relations Act, 1969 and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 14th October, 2011. The following is the Court's Recommendation:
RECOMMENDATION:
Having considered the submissions of the parties the Court recommends as follows:
- 1. The Company should provide the claimant with a copy of its grievance procedure. The claimant should process any appropriate issue through the procedure in writing.
2. The Claimant should engage fully with the Company in addressing any issue which it wishes to raise in relation to his conditions of employment.
