1. Complaint that a Rights Commissioner’s Decision has not been implemented R-095000-Mw-10/Mmg
BACKGROUND:
2. The worker referred his case to the Labour Court on the 24th June, 2011. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act, 2000 (the Act), by Muhammad Younis, C/O Migrant Rights Centre, 55 Parnell Square West, Dublin 1 that Amjad Hussein, trading as, Poppadom, 46 Rochfort Park, Lucan, Co Dublin failed to implement a decision of a Rights Commissioner No. r-095000-mw-10/MMG dated 31st March, 2011,
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €86,134.42 in accordance with the decision of the Rights Commissioner.
