1. Trade Dispute
BACKGROUND:
2. This case concerns a dispute between the Company and Union in relation to various issues. The issues have been outlined by the workers but the Company contends it is not aware of the specific nature of the issues in dispute. The dispute was referred to the Labour Court on 30th March, 2012 in accordance with Section 20(1) of the Industrial Relations Act, 1969. The worker's agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on the 26th June 2012, The following is the Court's Recommendation:
RECOMMENDATION:
Having considered the submissions of the parties the Court recommends as follows:
1. The issues before the Court should immediately be referred to the LRC for conciliation.
2. Every effort should be made to reach agreement on all issues in dispute.
3. Should the issues in dispute not be fully resolved in conciliation outstanding issues should be jointly referred to the Court under Section 20(2) of the Industrial Relations Act, 1969.
