1. Complaint that a Rights Commissioner's Decision has not been implemented r-111612-hs-11
BACKGROUND:
2. The Worker referred her case to the Labour Court on the 10thApril 2012, in accordance with Section 29(8) of the Safety, Health and Welfare at Work Act 2005.
DETERMINATION:
A complaint having been received under Section 29(8) of the Safety, Health and Welfare at Work Act, 2005 (the Act) by Adrienne Lynch, that her former employer Clonberne Community Centre Company Limited, Clonberne, Ballinasloe, Co. Galway failed to implement a Decision of a Rights Commissioner, No. r-111612-hs-11 dated 19th January, 2012.
And the said Decision not having been carried out by the Employer,
And no appeal having been brought against the said Decision within the time limit for such appeals,
The Court hereby determines that the said Employer must pay the Employee the sum of €12,000.00 in accordance with the Decision of the Rights Commissioner.
