1. Appeal of Rights Commissioner's Decision r-105718-mw-11.
BACKGROUND:
2. The Claimant appealed the Rights Commissioner's Decision to the Labour Court on 30th September, 2011. A Labour Court Hearing took place on 22nd March, 2012. The following is the Labour Court's Decision:
DETERMINATION:
This matter came before the Court by way of an appeal by Lina Rupainyte (the Claimant) against the decision of a Rights Commissioner under the National Minimum Wage Act 2000 (the Act) in her claim against Fazal Hamadi t/a The Big Bite Take Away (the Respondent).
The Claimant had contended before the Rights Commissioner that she had been paid less than the National Minimum Wage in respect of her employment with the Respondent. The Rights Commissioner found that the Claimant had been paid in accordance with the Act.
The parties were notified of the date, time and place of the hearing of her appeal. Neither the Claimant nor the Respondent attended the hearing.
In these circumstances it is the Determination of the Court that the appeal be dismissed and the decision of the Rights Commissioner affirmed.
