1. Alleged non-implementation of Rights Commissioner's Decision R-084415-MW-09/GC.
BACKGROUND:
2. The Worker referred her case to the Labour Court on the 20th February, 2012, in accordance with Section 31(1) of the National Minimum Wage Act, 2000.
DETERMINATION:
A complaint having been received under Section 31(1) of the Minimum Wage Act, 2000 by Ms. Helen Gurtiza that William Carroll, Mile Tree, Clonmel, Co. Tipperary failed to implement a decision of a Rights Commissioner, No. r-084415-mw-09/GC dated 27thMay 2011.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeals, the Court hereby determines that the said Respondent must pay the Complainant the sum of €4,825.00 in accordance with the decision of the Rights Commissioner.
