Appellant’s Case
The appellant told the Tribunal that he had started working for the respondent in May 2007. His hours of work were reduced without his consent more than a year before the respondent’s business closed down on 09 February 2010.
Determination
The Tribunal accepts the appellant’s uncontested evidence that her employment ended as a result of a redundancy. The Tribunal finds that she is entitled to a redundancy lump sum under the Redundancy Payments Acts 1967 to 2007 based on the following information:

Date Employment Began 14 May 2007
Date Employment Ended 09 February 2010
Gross Weekly Wages €177.40
The Tribunal makes this award based on the appellant’s actual wages when her employment ended and not on her wages as specified in her contract.
This award is made subject to the appellant having been insurable employment under the Social Welfare Acts during the relevant period.
The appeal under the Minimum Notice and Terms of Employment Acts 1973 to 2005 succeeds and the appellant is awarded the sum of €254.80 being two weeks’ pay.
