The decision of the Tribunal was as follows:
This case came before the Tribunal by way of an employee appeal of a Rights Commissioner recommendation under the Terms of Employment Acts, 1994 and 2001, reference r-109765-te-11/JW.
The appellant’s representative told the Tribunal that the appellant is employed as a General Operative with the respondent company with a gross weekly wage of €605.60. The representative told the Tribunal that the appellant does not remember receiving terms and conditions of employment but that in any event the terms given did not fully comply with Section 3 of the Terms of Employment Acts, 1994 and 2001.
The respondent submitted that the terms covered the main requirements of the Act.
Having considered the evidence adduced, the Tribunal upsets the recommendation of the Rights Commissioner and awards the appellant the sum of €1,211.20 under the Terms of Employment (Information) Acts, 1994 and 2001.
