This appeal came before the Tribunal by way of an employee (the appellant) appealing against a Recommendation of a Rights Commissioner (reference: r-106659-te-11/SR).
Background:
The appellant was a HGV driver with the respondent. A copy of the respondent’s handbook was produced to the Tribunal and the appellant contented that it did not comply with Section 3 of the Terms of Employment (Information) Acts 1994 to 2001.
Determination:
The Tribunal finds that there was insufficient evidence to support the appellant’s contention that the respondent was in breach of the legislation. The appeal under the Terms of Employment (Information) Acts 1994 and 2001 fails. The recommendation of the Rights Commissioner is upheld.
