Determination

The appellant attended the first day of hearing with his representative. Evidence was given to the Tribunal. On the second day of hearing there was no appearance or representation on behalf of the appellant. The appellant’s representative informed the Tribunal that they no longer had instructions from the appellant but that as far as they were aware, he intended on withdrawing his appeal.

The Tribunal are satisfied that the appellant was properly on notice of this hearing. The Tribunal dismiss the employee appeal of the Rights Commissioner Recommendation ref: r-108587-ud-11/SR under the Unfair Dismissals Acts, 1977 to 2007.
