The determination of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the Liquidator. The Tribunal is satisfied that the Liquidator was on notice of the hearing. The claimant stated that he had received a redundancy payment. He did not wish to pursue an unfair dismissals claim.
Determination:
The Tribunal is satisfied that the claimant’s employment was terminated by reason of redundancy and that he subsequently received a redundancy payment. Accordingly the Tribunal dismisses the appeal under the Redundancy Payments Acts, 1967 to 2007.
Unfair dismissal and redundancy being mutually exclusive the Tribunal dismisses the claim under the Unfair Dismissals Acts, 1977 to 2007.
