1. Complaint that Rights Commissioners Decision has not been implemented r-122224-wt-12/JT.
BACKGROUND:
2. A complaint by a Worker was submitted to the Labour Court on 7th January, 2013 in accordance with Section 28(8) of the Organisation of Working Time Act, 1997.
The following is the Court's Determination:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 (the Act) byMr. Kiran Darimdur, that his former Employer, Dinaltic Limited trading as John Doyle's Pub, Doyle's Corner, 160 Phibsborough Road, Phibsborough, Dublin 7 and having its registered office at Ardamine, Courtown Harbour, Gorey, Co. Wexford failed to implement a Decision of a Rights Commissioner, No.r-122224-wt-12/JTdated 2ndNovember 2012.
And the said Decision not having been carried out by the Employer,
And no appeal having been brought against the said Decision within the time limit for such appeals,
The Court hereby determines that the said Respondent must pay the Complainant the sum of €2,000.00 in accordance with the Decision of the Rights Commissioner.
