1. Grievance concerning promotion.
BACKGROUND:
2. This dispute concerns the Worker's claim that he was unfairly denied promotion. The Worker referred this case to the Labour Court on 2nd July, 2012, in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 16th November, 2012.The Employer did not send in a submission and declined to attend the hearing.
WORKER'S ARGUMENTS:
3. 1. The Worker was unfairly denied promotion.
2. A less senior colleague was instead promoted.
3.The Employer's decision caused the Worker significant financial loss.
RECOMMENDATION:
The Court notes that the subject matter of this dispute has been fully dealt with through the internal grievance procedures of the City Council. The Claimant's grievance was not upheld.
Having regard to all the circumstances of the case the Court can see no justifiable basis upon which it could interfere with the outcome of the internal procedure.
In these circumstances the Court does not recommend concession of the Claimant's claim.
