1. Complaint that a Decision of a Rights Commissioner has not been complied with by the Employer r-121946-mw-12/JC.
BACKGROUND:
2. The Worker referred his case to the Labour Court on the 30th May, 2013, in accordance with Section 31(1) of the National Minimum Wage Act, 2000. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act 2000 by Vivan George Udoka, c/o KOD Lyons Solicitors, 4 Arran Quay, Dublin 7, that her former employer, Rosemary Kifordu, 3 Birchdale, Westminster Park, Foxrock Dublin 18, failed to implement a decision of a Rights Commissioner r-121946-mw-12/JC
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €45,918 in respect of arrears of wages and €500 in respect of expenses in accordance with the decision of the Rights Commissioner.
