1. Complaint that Rights Commissioner's Decision has not been complied with or fully complied with by the Employer r-099449-mw-10/JC.
BACKGROUND:
2. The Worker referred her case to the Labour Court on the 23rd January, 2013, in accordance with Section 31(1) of the National Minimum Wage Act, 2000.
DETERMINATION:
A complaint having been received under Section 31(1) of the Minimum Wage Act, 2000 by Jurgita Diliute, 7 The Quay, Markspoint, Mullingar, Co. Westmeath that her former Employer East Punjab Limited, Oliver Plunket Street, Mullingar, Co. Westmeath and having its registered office at 59 Crann Nua, Portarlington, Co. Laois failed to implement a Decision of a Rights Commissioner, No.r-099449-mw-10/JC, dated 18thOctober, 2012.
And the said Decision not having been carried out by the Employer, and no appeal having been brought against the said Decision within the time limit for such appeals, the Court hereby determines that the said Respondent must pay the Complainant the sum of €6,799.50 in accordance with the Decision of the Rights Commissioner.
