1. Cabin Crew Management Team Restructure
BACKGROUND:
2. This case concerns a dispute between the Company and Union in relation to the restructuring of the Cabin Crew Management Team. The Union (on behalf of the workers) referred the matter to the Labour Court on 8th March, 2013. A Labour Court hearing took place on 24th April, 2013. The following is the Court's Recommendation:
RECOMMENDATION:
The matter before the Court brought by the Union under Section 20(1) of the Industrial Relations Act, 1969 concerns a claim on behalf of 23 Claimants concerning the restructuring of the Company’s Cabin Crew Management team.
The Court has considered the submissions before the Court and is of the view that the case had been prematurely referred. Accordingly, the Court recommends that without prejudice to either party’s position the parties should jointly return to the conciliation services of the Labour Relations Commission with a view to identify the remaining issues in dispute. This process should take place at the first available opportunity as a matter of urgency and any unresolved matters should be referred to the Court under Section 26(1) of the Industrial Relations Act, 1990.
The Court so recommends.
Signed on behalf of the Labour Court
Caroline Jenkinson
