The decision of the Tribunal was as follows:-
Background:
The claimant was employed by the respondent from October 2010 to November 2011. In November 2011 the claimant told the respondent that he had acquired a new job and was leaving.
Claimant’s Position:
The claimant stated that he had left of his own accord and had informed the respondent a couple of days before he had left his employment.
Respondent’s Position:
The respondent contends she had not dismissed the claimant and he had not given her any prior notice of the termination of his employment. She only became aware of his new job when his new employer contacted her for a reference.
Determination:
The claimant left of his own accord but states he gave some notice to his employer. Conflicting evidence was adduced by the respondent in this case. The Tribunal finds the respondent’s evidence to be credible and therefore the claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 fails.
