The decision of the Tribunal was as follows:-
Determination:
The Tribunal finds exceptional circumstances arose in this matter to extend the time limit to lodge an appeal under the Redundancy Payments Acts, 1967 to 2007 to two years and also finds redundancy situation did occur in this case.
Accordingly the appeal under the Redundancy Payments Acts, 1967 to 2007 is allowed and the appellant is awarded a statutory lump sum under those Acts and based on the following:
Date of Birth: 02 January 1951
Date of Commencement : 10 March 2003
Date of Termination: 28 August 2009
Gross Weekly Wage: € 680.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
It should be noted that payments from the social insurance fund are limited to a maximum of €600.00 per week.
