APPEAL(S) OF: CASE NO.
EMPLOYEE RP406/2012
- Appellant
against
EMPLOYER - Respondent
under
REDUNDANCY PAYMENTS ACTS, 1967 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr C. Corcoran B.L.
Members: Mr C. Lucey
Mr M. O'Reilly
heard this appeal at Dublin on 27th September 2013
Representation:
Appellant(s) : In Person
Respondent(s) : In Person
The decision of the Tribunal was as follows:-
Background:
The appellant was made redundant from his position on the 30th December 2011 and was given a statutory redundancy payment. The appellant lodged a claim under the Redundancy Payments Acts, 1967 to 1977 on the 22nd March 2012.
On the 23rd August 2013 the appellant lodged a claim under the Unfair Dismissals Acts, 1977 to 2007. On the day of this case the appellant said that he had already received a statutory redundancy payment and was informed by the Tribunal that he could not be awarded any further redundancy payment. He was also advised that if he was to lodge a claim for unfair dismissals, at this stage, it would be out of time.
Determination:
Accordingly the Tribunal has no jurisdiction to hear the claim under the Redundancy Payments Acts, 1967 to 2007.
