The decision of the Tribunal was as follows:-
The Tribunal was satisfied that the respondent was duly notified of the hearing.
The appellant claimed that his employment, which commenced on 4 August 2008, was terminated by the respondent by reason of redundancy due to lack of work on 17 June 2011. The appellant’s gross weekly pay was €642.69. The appellant maintained that the employer had not denied his entitlement to a redundancy lump sum payment but that the employer informed him that he could not afford to pay it.
Determination:
The Tribunal is satisfied that the claimant was dismissed by reason of redundancy and determines that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following details:
Date of birth: 28 November 1985
Date of commencement: 04 August 2008
Date of termination: 17 June 2011
Gross weekly pay: €642.69
It should be noted that payments from the Social Insurance Fund are limited to a maximum of €600.00 per week.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
