Background:
The appellant was employed for a number of years with the respondent company as a Financial Controller. The appellant’s employment terminated by reason of redundancy on 11 July 2012. The appellant was paid statutory redundancy but it was agreed in writing that he would receive an ex-gratia payment pertaining to holidays and remaining contract notice. He accepted the redundancy situation on these grounds but to date he has not received the outstanding sum.
Determination:
The Tribunal does not have jurisdiction under the Redundancy Payments Acts, 1967 to 2007, in relation to ex-gratia payments. Accordingly, on these grounds the Tribunal must dismiss the appeal.
