The decision of the Tribunal was as follows:-
This case came to the Tribunal as an employer appeal under the Terms of Employment (Information) Acts, 1994 and 2001, against Rights Commissioner Recommendation r-120569-te-12/JW by which the employee was awarded the sum of €500.00.
When the Tribunal convened to hear this appeal the appellant’s representative appeared without a client and said that he had no instructions.
Determination:
Given that there was no appearance for the appellant company to instruct its legal representative, the Tribunal has no alternative but to find that the appeal under the Terms of Employment (Information) Acts, 1994 and 2001, against Rights Commissioner Recommendation r-120569-te-12/JW (by which the employee was awarded the sum of €500.00) falls for want of prosecution.
