EMPLOYMENT APPEALS TRIBUNAL
APPEAL OF: CASE NO.
EMPLOYEE, UD1197/2012
-appellant
against the recommendation of the Rights Commissioner in the case of:
EMPLOYEE -v-
EMPLOYER
under
UNFAIR DISMISSALS ACTS, 1977 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms M. Levey B.L.
Members: Mr. J. Goulding
Mr. A. Butler
heard this appeal at Dublin on 6th November 2013
Representation:
Appellant: In person
Respondent: No appearance or representation
Background:
This case is before the Tribunal by way of an employee appealing the Recommendation of a Rights Commissioner ref: r-119927-ud-12/SR, under the Unfair Dismissals Acts, 1977 To 2007.
Determination:
There was no appearance by the employer. The Tribunal is satisfied that proper notification was sent to the above named employer.
Having heard the uncontested evidence from the employee the Tribunal determines that the employee was unfairly dismissed. The Tribunal determines compensation to be the most appropriate remedy. Accordingly, the Tribunal upsets the Rights Commissioner Recommendation ref: r-119927-ud-12/SR and the Tribunal award the employee the sum of €15,000.00, under the Unfair Dismissals Acts, 1977 To 2007.
Sealed with the Seal of the
