The notice of the hearing was sent to the claimant at the address he provided to the Tribunal by registered post on 19 September 2013. The Tribunal secretary checked through An Post’s track and trace facility and obtained a delivery record showing that the hearing notice was delivered to the address provided on 20 September 2013 and was signed for by the claimant. Accordingly, being satisfied that the claimant was properly on notice of the hearing, the Tribunal finds that the claim under the Unfair Dismissals Acts, 1977 to 2007 fails for want of prosecution.
