The determination of the Tribunal was as follows:
Having heard that the respondent is conceding the redundancy appeal and satisfying itself that the claimant ‘s employment with the respondent was terminated by way of redundancy the Tribunal allows the appeal under the Redundancy Payments Acts, 1967 to 2007 based on the following:
Date of Birth: 08 July 1955
Date of Commencement : 01 March 1996
Date of Termination: 16 September 2011
Non-Reckonable Service: 27 November 2009 to 17 March 2010 ( lay off period)
Gross Weekly Wage : €666.80
A weekly statutory ceiling of €600.00 applies to payments from the Social Insurance Fund.
This award is made subject to the appellant having being in insurable employment during the relevant period.
The claim under the Unfair Dismissals Acts, 1997 to 2007 and the appeals under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, and the Organisation of Working Time Act, 1997 were withdrawn during this hearing.
