for implementation of the recommendation of the Rights Commissioner
in the case of:

Claimant(s) : In person
Respondent(s) : In person
The determination of the Tribunal was as follows:
This case came before the Tribunal where the claimant was seeking implementation of the recommendation of the Rights Commissioner under the Unfair Dismissals Acts, 1977 to 2007, reference r-125257-ud-12/MMG and the Terms of Employment (Information) Act, 1994, reference r-125258-te-12/MMG.
Both parties attended the hearing.
The claimant confirmed that the recommendation of the Rights commissioner was not implemented and the employer confirmed that monies had not been paid as yet.
The Tribunal is satisfied that the recommendation of the Rights Commissioner has not been carried out by the respondent in accordance with its terms or at all and it is further satisfied that the prescribed six-week time limit for bringing an appeal against the recommendation has expired and no such appeal has been brought. Accordingly, the Tribunal makes a determination to like effect as the Rights Commissioner’s recommendation that the respondent pays the claimant €12,500 under the Unfair Dismissals Acts, 1977 to 2007 and €1,500 under the Terms of Employment (Information) Act, 1994 .
