The determination of the Tribunal was as follows:-
Determination
The respondent’s representative conceded a redundancy situation existed and informed the Tribunal that an error in the calculation of the claimant’s redundancy led to the claimant not receiving his full entitlement. A significant proportion of the redundancy was paid and the respondent had hoped to make the final payment.
The claimant’s representative agreed that a portion of the redundancy was received and the sum of €3161.40 remains outstanding.
The Tribunal awards the claimant a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria:
Date of Birth: 01 March 1961
Date of Commencement: 29 January 1997
Date of Termination: 03 February 2011
Gross Pay: €585.00
It should be noted that it was agreed between the parties that the claimant has received the amount of €16988.40 and the sum of €3161.40 is outstanding. Please note that this award is made subject to the claimant having been in insurable employment under the Social Welfare Acts during the relevant period
The claim under the Unfair Dismissals Acts, 1967 to 2007 was withdrawn by the claimant.
