Determination:
From the submissions made to the Tribunal it was evident that there was a break in the service of the claimant. The respondent was closed for a period in excess of seven months. The claimant was let go when the premises was closed for renovation. He was re-employed when it opened. His service was less than a year with the employer after his re-employment. The break in service was more than six months and therefore his employment was not deemed to be continuous. As the claimant did not have a year’s service the Tribunal must refuse jurisdiction in the matter.
