The decision of the Tribunal was as follows:-
A claim was brought on behalf of a newspaper editor under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, in respect of an employment from 3 February 2005 to 28 February 2011 at a gross weekly pay of €2,457.69 per week. It was acknowledged that the claimant had received a notice payment from the State at €600.00 per week but a determination was sought from the Tribunal in respect of the balance still due to the claimant under minimum notice legislation.
SW (an employee of the receiver) did not contest but, rather, supported the minimum notice claim.
Determination:
Allowing the claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, the Tribunal awards the claimant the sum of €7,430.76 (this amount being equivalent to four weeks’ gross pay at €2457.69 per week less the payment already received of €2,400.00 i.e. four weeks’ gross pay at €600.00 per week).
