This case came before the Tribunal by way of an appeal against recommendations of a Rights commissioner references r-120050-pw-12/EH and r-120045-te-12/EH
The decision of the Tribunal was as follows:
The Tribunal finds it had no jurisdiction to hear the appeal under the Payment of Wages Act, 1991 as the appellant did not comply with section 7 (2) (b) of that Act.
Accordingly, the Tribunal upholds and reaffirms the recommendation made by the Rights Commissioner in this case and determines that the appellant discharges the sum of €247.92 to the respondent under the above Act.
The appeal under the Terms of Employment (Information) Act, 1994 to 2001 fails as the Tribunal is satisfied that the appellant did not properly comply with that Act in dealing with respondent as an employee. The Tribunal upholds and reaffirms the recommendation of the Rights commissioner in this case and awards the respondent €500.00 as compensation under that Act.
