The decision of the Tribunal was as follows:-
This case came to the Tribunal as an employer appeal under the Payment of Wages Act, 1991, against Rights Commissioner Decision r-106778-pw-11 by which the respondent employee was awarded the net sum of €2,057.82 and under the Terms of Employment (Information) Acts, 1994 and 2001, against Rights Commissioner Decision r-106779-te-11 by which the respondent employee was awarded the sum of €1000.00.
The employer, not having attended or been represented at the Rights Commissioner hearing on 24 June 2011, appealed the decisions on the grounds that the Rights Commissioner had erred in fact and law.
The solicitors for the respondent employee disputed the above appeals.
There was no attendance by or on behalf of the employer at the hearing although a hearing notice was sent to the employer. The hearing was attended by the respondent, his legal representation and a Tribunal-appointed interpreter.
Determination:
Given the non-attendance of the appellant employer, the Tribunal affirms Rights Commissioner Decision r-106778-pw-11 under the Payment of Wages Act, 1991, by which the respondent employee was awarded the net sum of €2,057.82, and dismisses the said appeal under the Payment of Wages Act, 1991, for want of prosecution.
Given the non-attendance of the appellant employer, the Tribunal affirms Rights Commissioner Decision r-106779-te-11 under the Terms of Employment (Information) Acts, 1994 and 2001, by which the respondent employee was awarded the sum of €1000.00 and dismisses the said appeal under the Terms of Employment (Information) Acts, 1994 and 2001, for want of prosecution.
