Determination
The respondent having conceded liability in this regard, the Tribunal finds that the appellants are entitled to a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following criteria:
Appellant No 1.
Date of Birth: 20 March 1985
Date of commencement of employment: 16 June 2003
Date of termination of employment: 23 December 2011
Gross weekly pay: €478.75
The Tribunal is also satisfied that Appellant No 1 did not receive his statutory entitlement under the Minimum Notice and Terms of Employment Acts 1973 to 2005. Accordingly the Tribunal awards Appellant No 1 the sum of €1915.00 this sum being the equivalent of four weeks’ pay under the said Act.
Appellant No 2
Date of Birth: 8 January 1953
Date of commencement of employment: 1 January 2004
Date of termination of employment: 22 December 2011
Gross Weekly pay: €552.10
The Tribunal is also satisfied that Appellant No 2 did not receive his statutory entitlement under the Minimum Notice and Terms of Employment Acts 1973 to 2005. Accordingly the Tribunal awards Appellant No 2 the sum of €2208.40 this sum being the equivalent four weeks’ pay under the said Act.
These awards are made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
