This case had previously come before the Tribunal on 10^th December 2009. There was no appearance by or on behalf of the appellant on that occasion and the case was dismissed for want of prosecution.

The appellant was unhappy with that decision and told the Tribunal that he was in hospital at the time of that hearing but did not notify the Tribunal of this fact.

As a determination has already issued in respect of this matter the Tribunal must refuse jurisdiction to hear this appeal under the Redundancy Payments Acts, 1967 to 2007.
