The decision of the Tribunal was as follows:
The appeal was not referred to the Tribunal within the 52 week period as set out in the above Acts and the Tribunal have discretion to extend the time to 104 weeks if there is reasonable cause. The Tribunal accepts that Section 24 (1)(B) was satisfied, as the appellant made a claim for payment in writing to the employer, as evidenced by the appellant and also referred to in the employer’s T2 form.
The Tribunal is satisfied that a redundancy situation existed and accordingly finds that the appellant is entitled to payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Employment commenced 16th October 2006
Employment ended 28th February 2011
Gross pay €480
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
