The appellant began his employment with the respondent as an apprentice green keeper on 16 March 2009. The apprenticeship was successfully completed on 15 March 2013. On 1 March 2013 the secretary of the respondent wrote to the appellant giving him two weeks’ notice of the termination of his employment following the completion of his apprenticeship.
Section 7 (4) of the Redundancy Payments Acts provides
“Notwithstanding any other provision of this Act, where an employee who has been serving under an apprenticeship agreement is dismissed within one month after the end of that period, that employee shall not, by reason of that dismissal, be entitled to redundancy payment.”
The Tribunal, being satisfied that the appellant’s dismissal was within one month after the completion of his apprenticeship, finds that the appellant is not entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007.
