The decision of the Tribunal was as follows:-
The appellant claimed that her employment, which commenced on 11 August 2000, ended without notice by reason of redundancy on 3 November 2011. Her gross weekly pay was €150.00 (based on fifteen hours per week at €10.00 per hour).
It was acknowledged by the appellant that she had already received the sum of €2,500.00 as a redundancy payment from her employer. However, regarding notice, she said that she had received none but, rather, that she had just been taken off the employer’s roster.
No evidence was offered at the hearing by or on behalf of the respondent.
Determination:
Under the Redundancy Payments Acts, 1967 to 2007, the Tribunal finds that the appellant is entitled to a redundancy lump sum (net of the €2,500.00 already received by the appellant as a redundancy payment) based on the following details:
Date of birth: 19 July 1951
Date of commencement: 11 August 2000
Date of termination: 03 November 2011
Gross weekly pay: €150.00 (based on fifteen hours per week at €10.00 per hour)
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
Also, allowing the claim lodged under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, the Tribunal awards the appellant the sum of €900.00 (this amount being equivalent to six weeks’ gross pay at €150.00 per week).
