Determination
The Tribunal is satisfied that both parties were properly on notice of the hearing. The Tribunal considered the uncontested evidence of the claimant and the failure of the respondent to justify the dismissal. Based on this the Tribunal is satisfied that the claimant was unfairly dismissed from his employment. The Tribunal notes that the claimant has not been in employment since the termination of his employment with the respondent company. In that respect the Tribunal is satisfied that the claimant has made numerous attempts to secure alternative employment.
In those circumstances the Tribunal awards the claimant the sum of €33,000.00 under the Unfair Dismissals Acts 1977 to 2007. The Tribunal also awards the claimant the sum of €1347.12 this sum being the equivalent of four weeks’ pay under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
The Tribunal furthermore awards the claimant the sum of €280.54 in respect of unpaid holidays under the Organisation of Working Time Act 1997.
The claim under the Redundancy Payments Acts 1967 to 2007 is dismissed.
