These cases came before the Tribunal with the claimant making a first instance claim under the Unfair Dismissals Acts and the respondent in that claim seeking to appeal recommendations of a Rights Commissioner R-120621-TE-12/GC and R-120619-WT-12/GC under the Terms of Employment (Information) Acts and the Organisation of Working Time Act.
Determination:
The Tribunal being satisfied that the claimant was properly on notice of the hearing acceded to the applications on behalf of the respondent that the claim under the Unfair Dismissals Acts, 1977 to 2007 fails for want of prosecution and that the recommendations of the Rights Commissioner under both the Terms of Employment (Information) Acts, 1994 and 2001 and the Organisation of Working Time Act, 1997 are set aside.
