The determination of the Tribunal was as follows:-
The unfair dismissal claim brought by the claimant was conceded by the respondent.
Giving sworn testimony as to loss incurred since the dismissal, the claimant told the Tribunal of
extensive efforts made by her to mitigate her loss by obtaining new employment.
The claimant’s loss, net of remuneration from any temporary employment she did succeed in getting, was submitted to have been €24,736.00. Her gross weekly pay was €270.00.
Determination:
Given that the respondent conceded the unfair dismissal claim, the Tribunal allows it. The Tribunal, satisfied that the claimant had done all she could to mitigate her loss, accepts that the claimant had incurred the loss stated.
Allowing the claim under the Unfair Dismissals Acts, 1977 to 2007, the Tribunal deems it just and equitable to award the claimant compensation in the amount of €24,736.00 (based on a gross weekly pay of €270.00) under the said legislation.
