The determination of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the respondent company. The Tribunal is satisfied that the respondent company was on notice of the hearing.
The claimant gave evidence that he was employed as a butcher by the respondent company from 30th January 2009 until 18th February 2012. He broke his leg as a result of an accident at work for which he was hospitalised for a week. On his return to work he was dismissed without notice. On average he received €2,000 per month in wages. He began working in another job two months later at a rate of €1,600 per month.
Determination:
Having heard the uncontested evidence of the claimant the Tribunal finds that he was unfairly dismissed and awards him €10,200 (ten thousand, two hundred euro) under the Unfair Dismissals Acts, 1977 to 2007.
The Tribunal awards the claimant €1,000 (one thousand euro) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, in respect of two weeks’ pay.
