The decision of the Tribunal was as follows:
Having heard and considered the circumstances and background to this case the Tribunal is satisfied that the appellant’s employment with the respondent was terminated by way of redundancy. Accordingly, the appeal under the Redundancy Payments Acts, 1967 to 2007 succeeds and the appellant is awarded a statutory lump sum under those Acts, and based on the following:
Date of Birth: 05 January 1981
Date of Commencement : 23 November 2009
Date of Termination: 07 June 2012
Non-Reckonable Service 08 May 2012 to 07 June 2012 (lay-off period)
Gross Weekly Wage: €507.60
This award is made subject to the appellant having been in insurable employment under the appropriate Social Welfare Acts during the relevant period.
It was common case from the parties that the respondent discharged the sum of €2814.84 to the appellant as a statutory redundancy payment. The appellant confirmed the receipt of that amount.
