The claimant submitted her claim outside of the six-month time limit as set out in the above Act. The Tribunal can extend this time to twelve months if the claimant can satisfy the Tribunal that exceptional circumstance prevented her lodging her claim.
S 8. (2) of the 1977 Act as amended by S 7 (2) (b) of the 1993 Act states:
“if the rights commissioner or the Tribunal, as the case may be, is satisfied that exceptional circumstances prevented the giving of the notice within the period aforesaid, then, within such period not exceeding 12 months from the date aforesaid as the rights commissioner or the Tribunal, as the case may be, considers reasonable”
Having heard the claimant the Tribunal the claimant has not demonstrated any exceptional circumstances that prevented her lodging her claim. Therefore the Tribunal has no jurisdiction under the Unfair Dismissals Acts, 1977 To 2007.
